Wedding Contract

ENTIRE AGREEMENT

This Agreement contains the entire understanding between Photographer and the Client. There are no oral or other agreements of the parties. The only way to add or change this agreement is to do so in writing, signed by both parties.

DIGITAL FILES

It is agreed that ownership of the digital files will be given to the client upon delivery to client’s physical control. It is agreed that the photographer will have full rights to all images, the photographer does NOT guarantee archival of the digital files and will not be held responsible if loss occurs. Client understands that Photographer only stores files on personal computer for up to one full year. After a full year, Photographer may discard images to either be saved on a DVD or hard drive,

for backing up purposes and can not be held responsible for images not displaying after said time, if the client wishes to retrieve a copy after one year. If Client wishes to retrieve additional files after 6 months of the session that has been shot, Client agrees to pay a fee of $300.00. It is agreed that Bride is allowed up to 2 downloads of her wedding images.

DISPLAY

It is agreed that the photographer may display and use photographs for advertising, display, website, blogs and any other purposes thought proper by the photographer. It is also agreed that images are professionally edited by photographer, using up to date editing software to be able to display images of her choice.

RESERVATION DEPOSIT AND PAYMENT SCHEDULE

Upon signature the photographer reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the 50% deposit fee is non- refundable, even if the date is changed or photo-shoot is cancelled for any reason, including: acts of nature, fire, and severe weather.

Deposit fee is to be paid at the time of parties signing this contract. It is agreed that the photographer will show up, up to 30mins prior to session start time, at which there is no additional charge for this.

*The deposit fee is applied towards photography package**No images will be shot until full payment made** Remaining balance (50%) of session booked is to be paid minimum 1 month prior to wedding date.

PRE-EVENT CONSULTATION

The parties agree to a pre-event consultation before the event date in order to finalize the actual shooting times and locations. It is required to send an itinerary timeline to the photographer. During pre-event consultation, Client agrees to deliver signed copy of this contract along with any other paperwork provided by photographer. At this time all forms will be reviewed and a Boudoir / Engagement session (if applicable) will be selected by both parties for which is the best time and location. Client agrees to provide photographer with a “shot list” for formal family photographs (names of who is to have a photograph taken with the bride and groom during family shots pre or post ceremony), if such form is not provided, Photographer can not be held responsible for missed images.

METHOD OF PAYMENT

Payment may be made through Venmo, PayPal, cash or check.

ADDITIONAL FEES

Client agrees and is responsible for any additional fees (if applicable) such as, Travel, Parking, Hotel and Flight. Photographer will give Client additional fee/travel fee quote(s) in the invoice. Parking fees may be paid on the day of to determine such fee. Client agrees to pay and be billed at a rate of $200.00 per 1/2hour for any additional time that is shot passed initial agreed booking time.

MEALS/BREAK

Client agrees and is fully aware that the Photographer(s) is entitled to a short break at which food must be provided to photographer(s) by the venue to be paid for by the bride. If food is not going to be offered to photographer(s), bride and/or groom MUST notify photographer(s) prior to wedding in order to be able to make accommodations to bring or buy our own food. Break usually consists of 30-45mins and is taken after Bride and groom first dance. (while your guests are eating during the reception) At this time it is also noted that Photographers will not be photographing any guests.

DELIVERY

The digital photos will be provided to THE CLIENT in a timely manner. Due to the nature of the business, no exact time frame for delivery can be defined.

INDEPENDENT CONTRACTOR:

The photographer works as an independent contractor and client is fully aware and understands.

COOPERATION:

The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. Photographer is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, neither for missed images due to details not revealed to Photographer. Daniela Murray (photographer) recommends that THE CLIENT designate an "event guide" (see PRE-EVENT CONSULTATION above) to point out important individuals to the photographer(s), whom THE CLIENT wishes to include in informal or candid photographs.

CANCELLATION/REFUND:

In the event client must cancel the contracted services for photography, client understands and agrees that full deposit is non-refundable nor is the full amount paid towards booking the photography session. IF the cancellation occurred after full payment was made and In the event that something shall happen to the photographer or assistant and neither photographer nor assistant/second shooter can make it to shoot the wedding day, then a full refund may be issued.

FAMILY PORTRAITS: THE CLIENT will be responsible for (or have someone designated for this responsibility) identifying people/objects of whom/which specific photographs are desired. The photographer will NOT be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).

COPYRIGHT: The photographs produced by DANIELA MURRAY are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner. DANIELA MURRAY grants client permission to print photos once final payment received from client under the following conditions:
The digital images are the property of client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives.

The client must obtain written permission from DANIELA MURRAY prior to the client or its friends and relatives publishing or printing the photographs.

LIMIT OF LIABILITY:

Care will be taken with the digital files; the photographer limits any liability for loss, damage or failure to deliver photographs for any reason. In the unlikely event that the photographer is injured or becomes too ill to photograph the event or that photographs have been lost, stolen, or destroyed for reasons within or beyond DANIELA MURRAY’S control, responsibility and liability is limited to the return of all payments received for the event package.
